On December 2, 2024, the U.S. Citizenship and Immigration Services (USCIS) announced a significant update affecting applicants filing Form I-485, Application to Register Permanent Residence or Adjust Status. This update mandates that certain applicants must now submit Form I-693, Report of Immigration Medical Examination and Vaccination Record, concurrently with their Form I-485. Failure to do so may result in the rejection of the Form I-485 application. Previously applicants could submit without a medical and wait for a Request for Further Evidence (RFE).
Key Requirements:
- Mandatory Submission: Applicants for adjustment of status are required to complete an immigration medical examination and all necessary vaccinations. A properly completed Form I-693, signed by a USCIS-designated civil surgeon, must be submitted to demonstrate that the applicant is free from health conditions that would render them inadmissible under health-related grounds.
- Partial Form I-693: In some cases, applicants may only need to submit a partial Form I-693, such as the Vaccination Record. Regardless, it must be submitted with Form I-485 to avoid rejection.
- Revised Instructions: The instructions for Form I-485 have been updated to reflect this new requirement, emphasizing the necessity of filing both forms together.
Purpose of the Change:
This procedural change aims to streamline the adjudication process by reducing the number of Requests for Evidence (RFEs) issued by USCIS. By ensuring that all necessary medical documentation is submitted upfront, USCIS can more efficiently process applications and make timely determinations.
Additional Information:
For further details on the immigration benefits that necessitate an immigration medical examination and vaccinations, and to determine whether a civil surgeon or panel physician should conduct the examination, applicants are encouraged to consult Vol. 8, Part B, Chapter 3 • Applicability of Medical Examination and Vaccination Requirement of the USCIS Policy Manual. Alternatively consult with an experienced Immigration Attorney.
This update underscores the importance of adhering to USCIS requirements to ensure a smooth and efficient application process for adjustment of status.
